1. Scope and Definitions

These Terms and Conditions apply to all orders placed through the website maximzocktstudio.pro by consumers and businesses. These terms are governed by Austrian law, specifically the Austrian Consumer Protection Act (Konsumentenschutzgesetz - KSchG) and the Austrian Civil Code (Allgemeines Bürgerliches Gesetzbuch - ABGB).

"Consumer" means any natural person who enters into this legal transaction for purposes that are predominantly neither commercial nor self-employed.

2. Formation of Contract

2.1 Order Process

By clicking the "Place Order" button, you submit a binding offer to purchase the items in your shopping cart. We will confirm receipt of your order by email (order confirmation). The contract is concluded when we send you an order confirmation or, at the latest, when we ship the goods.

2.2 Order Confirmation

The order confirmation email will contain:

• Order number and date
• Description and quantity of items
• Total price including taxes and shipping costs
• Payment instructions
• Estimated delivery timeframe

3. Prices and Payment

3.1 Pricing

All prices displayed on our website are in Euros (EUR) and include Austrian VAT (20% USt). Shipping costs are calculated separately and displayed before order confirmation.

3.2 Payment Methods

Currently, we accept payment via bank transfer (advance payment). Payment instructions will be provided in the order confirmation email. Your order will be processed upon receipt of payment.

3.3 Retention of Title

The goods remain our property until full payment has been received (Eigentumsvorbehalt pursuant to § 1063 ABGB).

4. Shipping and Delivery

4.1 Delivery Area

We currently ship only within Austria. Delivery to other EU countries is not available at this time.

Unless otherwise stated, delivery times are:

• Standard shipping: 2-3 business days from receipt of payment
• Express shipping: Next business day (for orders placed before 14:00 CET)

Delivery is deemed completed when the goods are handed over to the Austrian Postal Service (§ 1064 ABGB).

5. Right of Withdrawal (Consumer Protection)

5.1 14-Day Withdrawal Right

As a consumer, you have the right to withdraw from this contract within 14 days without giving any reason, in accordance with § 11 of the Austrian Distance and Off-Premises Contracts Act (Fern- und Auswärtiges Geschäfte-Gesetz - FAGG).

5.2 Withdrawal Period

The withdrawal period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods.

5.3 Exercise of Withdrawal Right

To exercise your withdrawal right, you must inform us by email at kontakt@maximzocktstudio.pro of your decision to withdraw from this contract by an unequivocal statement.

5.4 Effects of Withdrawal

If you withdraw from this contract, we shall reimburse all payments received from you, including delivery costs (except for supplementary costs arising if you chose a delivery method other than the least expensive standard delivery), without undue delay and in any event not later than 14 days from the day on which we are informed of your decision to withdraw.

6. Warranty and Liability

6.1 Statutory Warranty

All goods come with statutory warranty rights according to §§ 922-933 ABGB. If goods are defective upon delivery, you have the right to repair, replacement, price reduction, or withdrawal from the contract.

6.2 Warranty Period

The statutory warranty period is 2 years from delivery of the goods (§ 933 ABGB).

6.3 Liability Limitations

Our liability for damages arising from slight negligence is limited to typical, foreseeable damages, except in cases of personal injury or breach of essential contractual obligations (Kardinalpflichten). This does not affect liability under Austrian product liability law.

7. Product Descriptions

We make every effort to ensure that product descriptions, images, and specifications on our website are accurate. However, minor variations in color or appearance due to different monitor settings do not constitute defects. All product dimensions and weights are approximate.

8. Intellectual Property

All content on this website, including text, images, logos, and designs, is the intellectual property of MaximZockt Studio Handels GmbH and is protected by Austrian and international copyright laws. Unauthorised reproduction or use is strictly prohibited.

9. Data Protection

We process your personal data in accordance with our Privacy Policy and applicable data protection laws, including the EU General Data Protection Regulation (GDPR) and the Austrian Data Protection Act (DSG).

10. Alternative Dispute Resolution

In accordance with the Alternative Dispute Resolution Act (Alternative-Streitbeilegungs-Gesetz - AStG), we inform you that:

11. Applicable Law and Jurisdiction

11.1 Applicable Law

These Terms and Conditions are governed by Austrian law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

11.2 Jurisdiction

For disputes with consumers, the place of jurisdiction is determined by the consumer's domicile or habitual residence. For disputes with businesses, the exclusive place of jurisdiction is Salzburg, Austria.

12. Severability

Should any provision of these Terms and Conditions be or become invalid, the validity of the remaining provisions shall not be affected. The invalid provision shall be replaced by a valid provision that comes closest to the economic intent of the parties.
